We compared the results in cases filed by McDonald Law Offices with cases that were either filed by another attorney, or that were filed by individuals without the assistance of an attorney. To make the comparison, we looked at the bankruptcy court records for Chapter 13 cases filed in Phoenix between March 1, 2011 and April 30, 2011. This is what we found: Graph All, 100%, of the Chapter 13 Plans filed by McDonald Law Offices were approved by the Chapter 13 Trustee and Bankruptcy Court within 12 months of the filing of the case. The average length of time between filing and approval was only 7.3 months. Not a single case filed by McDonald Law Offices was dismissed within the first 12 months of the filing of the case.

All other attorney’s combined only have 29.7% of their Chapter 13 Plans approved within 12 months of the filing of the case. Of the 29.7% of the plans that were approved, it took an average of 10.2 months to obtain approval. An astounding 14% of the Chapter 13 cases that were filed by other attorney’s were actually dismissed by the court within the first 12 months. When a case is dismissed it means that the case was rejected by the court and all creditors are allowed to resume their collection activity against the individual that filed the case. To make matters worse, the filing of the bankruptcy will remain on the credit report for ten years even though the case was dismissed and the individual received no benefit from the filing of the case.

Our analysis found no good news regarding the results for the cases filed without the assistance of an attorney. No Chapter 13 Plan filed without an attorney was approved within the first 12 months of the filing of the case. In fact, out of the 115 cases that were filed without the assistance of an attorney, 109 of those cases were dismissed within the first 12 months. That is an incredible 94.8%! Why were so many cases dismissed? The answer is quite simple, filing a Chapter 13 is a complicated process. An individual that files a case without an attorney is presumed to know the law. This means that there will be no one to help you. The court will not help you, and the trustee will not help you.

Cost counts! Cost is a very important consideration in choosing the right attorney. In Chapter 13, many attorney’s require that you pay anywhere between $750.00 and $2,500.00 before they will file the case for you. The bottom line is, why would you pay such fees when McDonald Law Offices will file the case for you for anywhere between $0.00 and $500.00 in upfront attorney’s fees. That is correct. In many cases, we are willing to file the case for you after you have paid only the cost of the credit report ($30.00 in a single case and $50.00 in a joint case), and the court filing fee of $310.00.
